Under New York law, it must be proven that the dog owner had prior knowledge of his dog's "vicious propensity" before the attack. A dog may be considered vicious if it has previously attacked a person or other animal, whether or not any injury actually occurred as a result of the attack. However, a previous attack is not a requirement if it can be shown that the dog behaves in a manner that indicates it "poses a substantial threat to others."
